The Last 4 Days to Register

This message is intended mainly for those who have not yet registered.

As the only person managing all the registrations, can I please ask you to ensure that you do not register more than once. Sorry to be so emphatic but with hundreds of registrations it’s important for your sake that you get it right first time, otherwise a duplicate registration may result in no registration. It is also your responsibility to ensure that you are legally entitled to register (especially if you register on behalf of someone else), if you aren’t the registration will be invalid. I’ve tried to assist a good number of people already but with the deadline approaching and my time being a limited resource, I can’t promise to help everyone to get this right.

We now have over £30m in claims from 276 investors, more are on the way and there are still 4 days to go.

  1. The lawyer we used for stage one was called Nick Makin but he acted on a no win no fee basis as a favour to one of our committee members. All that was involved was writing a letter of claim. His involvement ended then as there would have been charges if we continued to use him. I took on the application to the European Court of Human Rights myself but I should point out that there are strict elligibility rules, one of which is that you must have exhausted domestic remedies which may mean going through the UK courts first. You then have six months to make an application if your case is about a breach of human rights.

  3. I invested £20,500 and lost over £4k after the fund was suspended! I was told this was due to poor exchange rates.
    I was with an independent FA. am I entitled to join your, is it worth me registering?

    1. Are you sure you’re talking about the EEA fund Marie? I’m not sure how you could have lost due to exvchange rates in a fund that was suspended.
      If you are the beneficial owner of an investment in the EEA Life Settlements Fund, have been denied access to your funds and income and agree that this was casused by the FSA announcements on 28th November 2011, you are elligible to participate. If your investment in EEA is held in trust, your trustees must register.

    1) This class action isn’t open to ARM fund investors, so not to my knowledge as they wouldn’t be accepted.
    2&3) My view is that we should win in Europe but the chances of the FCA seeing sense before taking it to the wire are slim because that’s the mentality of people in posh offices who aren’t spending their own money. However, a win in Europe will set a legal precedent for ARM and other investors to follow up with their own claims, which I estimate will be several £billions. It will also wipe out the personal exemption from liability so anyone in the FSA/FCA or connected organisations who is shown to have unlawfully restricted a human right will be paying for their mistakes out of their own money. You may have individuals in mind to whom this will apply!

  5. Pete – as an ARM Fund Tranche 9 Bondholder (using Rockingham as my IFA) I duly claimed compensation from The FSCS and have received the maximum of £50,000 two week ago. My question to you is 1) have other ARM Fund investors submitted their names to your Class Action and 2) having received the maximum payout from FSCS, have I now lost any other opportunity of recompense? 3) there is still the question of my remaining funds and any sustained loss as a result of Mrs Coles defamatory comments – do you have a view on the likely outcome of this situation?   6. EEA was sold to investors all over the world, can the investors living overseas (outside the UK ) also participate in this class action? I know a few who would like to. Thanks for a quick reply.

    1. If you shouldn’t be getting these updates, you should unsubscribe from this website/blog. That’s the only reason you’re getting them.
